Abstract : Joint Liability Between E-Banks and Individuals: A Comparative Study Prepared by: Nadine Abdul Wahab Murshid Supervised by Dr. Amal Shalabi Abstract This study dealt in overall with the principals of mutual liability between electronic banks and individuals, and the determination of contractual and default liability in the Kingdom of Saudi Arabia and the United States of America through reviewing, analyzing and comparing them with the relevant legal texts in these countries; aiming to reach purposeful recommendations that clarify what is required for the drafting of the appropriate law that is considered effective in dealing with E- banking errors and defaults, which may cause massive damages to individual clients. This study is divided into three topics, preceded by a preliminary study, which includes the following topics in the following order: the emergence and development of electronic banks, followed by the definition of E-banking, then the liability of banks and individuals in E-banking, ended with situations regarding the liability of electronic banks and individuals. Finally, the study is concluded by presenting the main findings and recommendations.
